§ 1 Scope

These Terms of Service apply to the use of the mobile application "WatchNPlay" (hereinafter "App") and all associated services. By registering or using the App, you agree to these terms.

§ 2 Description of Service

WatchNPlay is a personal media tracker for video games, movies, and TV series. The App allows you to save titles to a watchlist, track release dates, and receive notifications about availability, deals, and new releases. The basic version of the App is free. Extended features may be offered as paid premium services.

§ 3 Registration and Account

Using the App requires registration via a third-party provider (Google or Apple). You are responsible for keeping your linked account credentials secure. Transfer of the account to third parties is not permitted.

§ 4 Premium Services and In-App Purchases

The App offers optional premium features ("WatchNPlay Pro") as subscriptions that can be purchased via in-app purchases. A monthly and an annual plan are available; current prices are displayed in the respective App Store before purchase. Payments are processed through the Google Play Store or Apple App Store. Subscription management and premium status verification are handled by RevenueCat (RevenueCat Inc., USA). The terms and payment conditions of the respective store also apply.

Auto-Renewal and Cancellation

Subscriptions renew automatically for the respective term unless cancelled at least 24 hours before the end of the current period. Cancellation must be done exclusively through the subscription management of the respective App Store (Google Play Store: Settings → Payments & subscriptions; Apple App Store: Settings → Apple ID → Subscriptions). Cancellation through the App itself or via email is not possible.

Right of Withdrawal for Digital Content

When purchasing digital content (e.g. premium subscriptions or one-time in-app purchases), your right of withdrawal expires upon commencement of contract performance, provided you have expressly agreed before purchase that performance may begin before the withdrawal period expires and have acknowledged that you thereby lose your right of withdrawal. This consent is obtained during the purchase process.

§ 5 Availability and Changes to the Service

We strive to ensure uninterrupted availability of WatchNPlay. However, there is no entitlement to constant, uninterrupted availability of the App or its server-side services.

We expressly reserve the right to modify, supplement, delete, or temporarily or permanently discontinue parts of the App or the entire offering without prior notice. In the event of permanent discontinuation, users will be informed in advance.

§ 6 Liability for Third-Party Content and Data Quality

The App and all information contained therein (e.g. release dates, prices, streaming availability, ratings) are provided "as-is" without any warranty. The App sources data from third-party providers (e.g. TMDB, IGDB, Steam). We assume no liability for the accuracy, completeness, or timeliness of this data.

§ 7 Limitation of Liability

We are liable without limitation for intent and gross negligence.

For simple negligence, we are only liable in the event of a breach of a material contractual obligation (cardinal obligation) whose fulfilment is essential for the proper performance of the contract and on whose compliance the user may regularly rely. In this case, liability is limited to the foreseeable, contract-typical damage.

The above limitations of liability also apply in favour of our agents and subcontractors.

§ 8 Final Provisions

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected.

Language Version

These terms were originally written in German. In the event of any contradictions or discrepancies between the translated and the German version, the German version shall be exclusively legally binding.
